Terms of Service
These Terms ("Terms") govern access to and use of CommunicaAI, a Sagentica product. By creating an account or using the Services you accept these Terms. If you accept on behalf of a business, you represent you have authority to bind it.
1. Service description
CommunicaAI provides AI-powered voice agents for inbound and outbound calls, trained on customer-supplied scripts and knowledge bases, with optional human escalation. Detailed feature scope by tier appears at /pricing.
2. Acceptable use
- No use for telemarketing in violation of TCPA, CAN-SPAM, or similar.
- No use for harassment, fraud, or impersonation.
- No collection of payment card data without PCI-DSS scope agreement.
- No use to circumvent consumer-protection laws (debt collection, credit reporting, etc.) without an applicable compliance attestation.
- Customer is responsible for obtaining caller consent to recording per state two-party-consent laws.
3. Fees + payment
Monthly flat + per-minute usage billed via Stripe. Tiers: Starter ($199/mo + $0.18/min), Growth ($699/mo + $0.14/min), Enterprise (custom). Non-refundable except as required by law or for documented billing errors.
4. Data + IP
- You retain ownership of your scripts, knowledge base, and voice samples.
- You grant us a license to process them as necessary to provide the Services.
- We will not use your data to train our shared voice or reasoning models without your explicit opt-in (opt-out by default).
- Aggregated, de-identified usage metrics may be used for internal capacity planning and security.
5. SLA + uptime
Growth and Enterprise tiers include a 99.5% uptime SLA on the voice infrastructure. Detailed SLA terms in the Master Service Agreement available on request.
6. Compliance posture
- SOC 2 audit in progress.
- HIPAA-eligible architecture available on Enterprise — BAA provided at /legal/baa.html.
- PCI-DSS scope-reduction architecture available on Enterprise.
7. Disclaimers
SERVICES PROVIDED AS IS. Voice AI may produce inaccurate outputs. Customer is responsible for configuring confidence floors and human escalation appropriate to their risk tolerance.
8. Limitation of liability
LIABILITY LIMITED TO FEES PAID IN THE 12 MONTHS PRECEDING THE CLAIM. NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
9. Indemnification
You indemnify us against claims arising from your content, your scripts, your use of the Services, your breach of these Terms, or your violation of law.
10. Termination
Either party may terminate for convenience on 30 days' written notice. Immediate termination for material breach. On termination we retain your data only as long as your retention policy specifies, then delete.
11. Governing law
Florida law. Exclusive venue in Miami-Dade County.
